CONFIDENTIALITY

Linguafield respects your right of confidentiality. The term “Confidentiality” stands for any information, in oral or written form, audio, visual, electronic or any other form that can be accessed by the Contractor at the discretion of the Client in relation to or as a result of the fulfillment of obligations including the unlimited:

(a) Information related to the marketing, advertising or other activity of the Client
(b) information related to the commercial policy, strategy or tactics of the client
(c) information provided to the Client by other parties and treated as confidential information that was communicated to the Contractor by the company.
(d) the term “confidential materials” includes all tangible materials that contain confidential information including all written or printed documents, compact discs or other information carriers if they can be read either using certain tools or without the use of such tools.

Contractor should not reveal or make accessible to the third party or use any confidential information or confidential materials except the cases that are allowed by the present contract, without prior written agreement from the Client.

Confidential information and/or confidential materials may be revealed or become accessible only to the staff, agents or certain subcontractors employed by the Contractor in a very limited scope and on condition that the Contractor guarantees that these staff follows the Agreement on Confidentiality with the same limitations as Agreement provides and follow the stipulations of the Contract.

Contractor undertakes the responsibility to take precautionary measures to ensure confidentiality of any confidential information and confidential materials.

Client has the right to make a written request to return any confidential information and confidential materials that had been given to the Contractor, back to the client at any time. This should be done in written or any other form that is acceptable in this process, along with the written statement signed by the Contractor or on its behalf certifying that after conducting an thorough research, the Contractor does not have, to the best of its knowledge, any remaining confidential information and/or confidential materials or copies of these documents at its disposal, either directly or indirectly. Contractor should implement any of the above requirements within seven (7) days from the moment of issuing such requirement.

Responsibilities set forth in the current Section should remain in force upon termination of this contract (expiration, breach, annulment) or following the transfer of authority on this Contract to the third party within the longest possible period based on the applicable law.
